Phoenix Phreedom, Inc. owns or lawfully controls the website, brand identity, written content, visual content, audio content, videos, assessments, educational materials, frameworks, methodologies, systems, processes, program structures, training materials, templates, workbooks, graphics, designs, recordings, downloads, and other original materials made available through Phoenix Phreedom services.
These materials may be protected by copyright, trademark, trade secret, contract, unfair-competition, and other applicable laws. All rights not expressly granted are reserved.
Phoenix Phreedom proprietary intellectual property includes, without limitation, the Phoenix Phreedom brand and its original frameworks, systems, assessments, methodologies, program names, profile names, diagrams, language, sequencing, scoring structures, interpretations, instructional models, and implementation materials.
This includes materials associated with the Emotional Operating System Audit, also known as EOSA, the Avalanche Method™, Phoenix Sovereign OS™, VERITY-MAP™, Phoenix Cleanup Cycle, Tolerance Cost Score, Diagnosis-to-Decision Matrix, Resistance Test, Decision Protection Plan, and other Phoenix Phreedom concepts and programs, whether currently published or in development.
The appearance of a name, title, framework, assessment, or system on the website does not grant permission to reproduce, teach, adapt, license, certify, distribute, or commercially use it.
When you lawfully purchase or access Phoenix Phreedom materials, you receive a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use those materials solely for the purpose stated at the time of purchase or access.
Personal access does not transfer ownership and does not include the right to reproduce, distribute, publish, upload, share, resell, sublicense, teach, facilitate, modify, create derivative works from, or commercially exploit the materials.
Unless Phoenix Phreedom provides prior written authorization, you may not:
Purchase or access by one individual does not authorize use by an organization, school, business, agency, department, team, class, membership community, coaching practice, consulting firm, or training program.
Organizational implementation, internal distribution, employee access, classroom use, facilitator use, assessment administration, professional development, research use, and institutional integration require a separate written licensing agreement.
Phoenix Phreedom may offer licensing arrangements to qualified organizations, institutions, educators, practitioners, consultants, facilitators, public-safety agencies, and other approved partners.
Licensing terms may address permitted users, duration, territory, delivery format, training requirements, certification standards, reporting, confidentiality, branding, data handling, quality control, fees, renewals, termination, and restrictions on modification or redistribution.
No licensing relationship exists unless it is confirmed in a written agreement signed by an authorized representative of Phoenix Phreedom, Inc.
Completing a Phoenix Phreedom program, assessment, course, membership, event, coaching engagement, or consulting engagement does not authorize you to identify yourself as a Phoenix Phreedom coach, facilitator, practitioner, trainer, assessor, consultant, licensee, or certified professional.
Those titles and permissions may only be used when expressly granted through an active written certification, facilitator, or licensing agreement.
Phoenix Phreedom names, logos, slogans, program names, product names, service names, visual identifiers, and related branding may function as trademarks or proprietary brand assets.
You may not use confusingly similar names, marks, domains, social media handles, graphics, or branding, or use Phoenix Phreedom branding in a manner that suggests sponsorship, endorsement, certification, ownership, or affiliation without prior written approval.
Brief quotations may be permitted when legally allowed and when accompanied by clear attribution, provided the quotation does not reveal protected assessment content, proprietary methods, confidential materials, or a substantial portion of a Phoenix Phreedom work.
Requests to reproduce excerpts, images, recordings, frameworks, exercises, assessment content, or other materials must be submitted in writing before use. Silence or failure to respond does not constitute permission.
You retain ownership of original materials you submit to Phoenix Phreedom unless a separate agreement states otherwise. By submitting materials necessary for us to provide a requested service, you grant Phoenix Phreedom a limited right to access, process, reproduce, and use those materials for that purpose.
You represent that you have the right to submit the materials and that our authorized use will not violate another person's intellectual-property, privacy, confidentiality, or contractual rights.
Certain Phoenix Phreedom materials may contain confidential, unpublished, proprietary, or trade-secret information. Access to those materials does not authorize disclosure or use beyond the purpose for which access was granted.
Confidentiality obligations contained in a membership, consulting, coaching, employment, contractor, partner, certification, or licensing agreement remain enforceable according to that agreement.
If you believe Phoenix Phreedom intellectual property is being copied, distributed, taught, sold, misrepresented, or otherwise used without authorization, please provide the location of the material, a description of the suspected use, relevant screenshots or documentation, and your contact information.
Phoenix Phreedom may investigate suspected violations and pursue available contractual, platform, administrative, or legal remedies.
Phoenix Phreedom may suspend or terminate access to materials, memberships, programs, accounts, or licensing privileges when it reasonably believes intellectual property has been misused or the applicable terms have been violated.
Termination does not eliminate obligations concerning ownership, confidentiality, payment, restrictions on use, or materials already obtained.
A delay or failure by Phoenix Phreedom to enforce an intellectual-property right does not waive that right. Permission granted for one use, person, project, platform, or period does not authorize any other use.
This page supplements the Phoenix Phreedom Terms of Use and any applicable purchase, membership, service, confidentiality, certification, or licensing agreement. When a signed agreement contains different terms for a specific relationship, that signed agreement controls for that relationship.
